1. Company Information

These Terms & Conditions govern your use of the services provided by KMA Buildcon Private Limited, a company incorporated in India in 2022. Our registered office is located at B Wing, Meenakshi CHS Ltd, Marve Road, Opp. HDFC Bank, Malad West, Mumbai, Maharashtra — 400064.

2. Services

KMA Buildcon provides the following services:

• Mobile application development (Android, iOS, cross-platform)
• Website and web application development
• Google Ads campaign management
• Meta Ads (Facebook & Instagram) campaign management
• Google Play Store app publishing and ASO
• App monetization strategy and implementation

All services are subject to a separate written agreement or proposal accepted by the client prior to commencement of work.

3. Client Obligations

By engaging KMA Buildcon, you agree to:

• Provide accurate, complete, and timely information required for project execution.
• Respond to queries and provide approvals within agreed timelines.
• Ensure that all materials, content, and assets provided to us do not infringe any third-party intellectual property rights.
• Pay invoices as per the agreed payment schedule.

4. Payment Terms

Payment terms will be specified in the project proposal or service agreement. Unless otherwise agreed in writing:

• A minimum advance payment is required before project commencement.
• Milestone-based payments apply to larger projects.
• Advertising budget payments (for Google Ads / Meta Ads) are separate from management fees and are paid directly to the respective platforms.
• Late payments may result in suspension of services.

5. Intellectual Property

Upon receipt of full and final payment, all deliverables created specifically for the client (code, designs, content) will be transferred to the client. KMA Buildcon retains the right to display completed work in its portfolio unless the client requests confidentiality in writing.

Third-party tools, libraries, fonts, and platforms used in deliverables are subject to their respective licences. KMA Buildcon is not responsible for licence changes by third-party providers.

6. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the engagement. This obligation survives the termination of the service agreement.

7. Limitation of Liability

KMA Buildcon's liability under any service agreement shall not exceed the total fees paid by the client for that specific engagement. We are not liable for indirect, incidental, or consequential damages including loss of revenue, data, or business opportunity.

For digital advertising services, we do not guarantee specific campaign outcomes (impressions, clicks, conversions, or revenue) as results are dependent on platform algorithms, market conditions, and client-provided assets.

8. Termination

Either party may terminate a service agreement with 14 days' written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. Prepaid advertising budgets are non-refundable once deployed.

9. Privacy

KMA Buildcon collects and processes client data solely for the purpose of delivering contracted services. We do not sell or share personal data with third parties except as required by law or as necessary for service delivery (e.g., sharing with Google or Meta for ad campaign management).

10. Governing Law

These Terms & Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

11. Amendments

KMA Buildcon reserves the right to update these Terms & Conditions at any time. Continued use of our services after any update constitutes acceptance of the revised terms. The most current version will always be available on this page.
